Will of Mary Ann Bain (nee Smith)

Proved London 5 October 1864

This is the last will and testament of me Mary Ann Bain of Croydon in the County of Surrey widow

After the payment of any debts that I may owe and of my funeral and testamentary expenses.

I devise and bequeath as follows.

To my daughter Mary Ann wife of George Smith the leasehold house and premises in Great Park Street Kennington Cross devised to me by the will of my late husband

To my granddaughters Matilda Ann wife of George William Smith and Mary Ann wife of Charles Gill the two leasehold houses in Vauxhall Street Kennington Lane which were devised to me and my late daughter Emma Bain as joint tenants by the said will that is to say to Matilda Ann Smith the shop and to Mary Ann Gill the private house.

My wearing apparel linen jewellry and trinkets I leave to my daughter Mary Ann Smith.

Such of my silver plate as I may not have given away prior to my decease I leave to my said daughter excepting the tea spoons that I have in common use which together with a pair of table spoons a pair of tureen spoons and a pair of salt spoons I leave to my son James Bain.

I direct my executors hereinafter named to sell my furniture books pictures china and household effects generally in such manner as they may consider desirable the proceeds to form part of the residue of my estate

and I give devise and bequeath all the rest residue and remainder of my Estate and Effects whatsoever as follows.

To my said daughter Mary Ann Smith two sevenths thereof.

To my said son James Bain two sevenths thereof.

To my Grandsons James and George sons of my late son George William Bain to be equally divided between them as tenants in common one seventh thereof

and to the children of my late daughter Eliza Trowell to be equally divided amongst them as tenants in common two sevenths thereof.

I appoint my said son-in-law George Smith and my friend Mr. William Hyslop Executors of this my Will.

In witness where of I have hereunto set my hand this eithteenth day of June one thousand eight hundred and sixty four Mary Ann Bain

Signed by the said Mary Ann Bain in the presence of us present at the same time and by us attested and subscribed in our presence the words "a pair of tureen spoons" having been first introduced in the twenty fourth line of the first side hereof and the words "George and" in the ninth line of the second side having been first struck out
